morning. victims they say of a law savoring landlord. i can't say the weather has been boring the past five days. we've had rain and temps. but today some very cool air is on the way. more scrutiny for the crash at sfo. ktvu channel 2 morning news continues. good morning. and here's a beautiful shot. a live look at the bay bridge from san francisco. lights are on. cool and breezy out there. could be a little windy on that bridge and that bridge likely to get a lot busier later today as people head in for that historic america's cup race. good morning, and welcome back to the morning news. it's wednesday, september 25th i'm claudine wong in for pam cook this morning.

>> it's the middle of the week. good morning, i'm dave clark. let's check weather and traffic. look what the wind blew in. >> we do have sunny day but it will be cooler and breezy and partly cloudy skies. maybe some scattered showers up in the sierra nevada. a couple of 40s. i have seen a few. i know napa downtown is close to 50. a lot of 50s. it will be a cool day. if it wasn't for any breeze, it would be a little cooler on these lows. 50 to start. for a high in santa rosa today. san francisco though it will be sunny but we are only going 67 degrees. the wind is definitely picking up. we are seeing 16-22 miles an hour in san francisco and around the bay. sunshine. breezy to windy. some of the higher elevations are showing gusts to 50 miles an hour. a lot of this will just be drier air coming in.

but it's also very cool air. cooler, breezy, today but lots of sunshine. and temperatures mainly 60s and 70s arkoses the board here. here is sal. steve, good morning. we are look pretty good so far. it's high winds obviously we've been talking about it for the bridges. so just be careful. on the east span we have a little bit of slowing as you get on to that bridge. you can see the traffic is moving along slowly as you approach the treasure island tunnel. at the toll plaza we are getting slow traffic. the metering lights are on. it's about a ten minute delay before you make it past the metering lights. we've also been looking at the south bay. nothing going on here. and 101 get into the valley and over to sunnyvale. 6:02 let's go back to the desk. the clock is also ticking toward another possible bart strike. take a look at this. the cooling off period ends in just 15 days. negotiations are set to resume in just a couple of hours from

now. in that bart labor dispute. in the meantime bart management has a new backup plan in caseworkers go on strike next month. ktvu janine de la vega is joining us live from the fremont bart station. good morning, janine. >> reporter: good morning, dave. one bart rider i spoke to this morning says he feels as if parking lot would be holding him and other passengers hostage. he's not sure what he would do as an alternative and he doesn't want to think about it. the mercury news is reporting that bart would operate 200 free charter buses for commuters that would shuttle people between the east bay and san francisco stations. that is triple the amount it ran during the first strike. bart is also weighing whether or not to offer limited train service to the transbay tube. bart says those will be operated by certified former train operators who were promoted to management. labor unions are against that proposed idea. riders are already feeling frustrated. >> i think that is the least

they can do. i'm glad they are doing it, but i think they've got to step up and do something else. because they are holding our lives in the balance. >> the paper reports that all day car pool lanes would be open on interstate 880 and 680 and temporary diamond lanes would be added to highway 24. other transportation services would chip in like ac transit and the ferries by boosting their number of boats and buses. the 60 day cooling off period ends on october 10th. so workers could go on strike the next day. reporting live janine de la vega ktvu channel 2 news. happening today an elderly san francisco couple is being evicted from their home. they say they are the victims of a state law favoring landlords. tara moriarty is joining us live to tell us more about why some say the law is changing the face of san francisco. tara. >> reporter: i guess the leads are supposed to be moving out

of here at 6:00 this morning. we have been here since 4:00 and we have not seen any movement. if you take a look behind me this is -- they have a 48-year- old disabled daughter and have raised seven children here. they say they have tried to find another place to live and can't. this eight unit rent controlled complex is on jackson and larkin streets. matthew miller bought it last year and his plans is to -- the case is just one in a rising number of evictions using the ellis act. a state law adopted in 1985 that allows the landlord to evict tenants. according to the city's tenants union the number of ellis acts evictions have tripled since the beginning of the year. with high numbers in china

town. the drop in a number of families and children in favor of the single white under 30 demographic. in june the board of supervisors voted for a ten year moratorium. now the state superior court cited with miller so the leads are supposed to leave today. we will tell you what david chiu plans to do to help people like the leads. tara moriarty ktvu channel 2 news. we have new information on a teacher arrested earlier this year on abuse charges. fifth grade teacher joseph martin had worked at wood side elementary school since 1991 and he is facing a possible life in prison sentence. if he is convicted of abusing more than a dozen former students. the contra costa times has uncovered an internal school district report from 2006 warning martin was a possible use step.

we have new information on the asiana air crash at sfo. federal investigators are reviewing whether or not asiana airlines failed to meet the legal obligations to help the families of the 291 passengers. asiana was required to provide a range of services. including transportation and lodging so family members could comfort injured loved ones. three people died and dozens were hurt. time is 6:07 oracle usa is one victory away from one of the greatest comebacks in sports history. yesterday oracle beat team new zealand twice. now there is one final race to begin this afternoon to decide who wins the america's cup.

yesterday the u.s. trailed new zealand eight points to one. new zealand needed one more victory to take back the oldest international sports trophy. this nail biting finish has stirred up pride and patriotism from both countries. >> it's just very, very satisfying. >> we were quite worried. the whole country is worried. >> >> oracle has won seven races in a low and that is really triggering fan interest. the america's cup park opens at 10:00 this morning. because of the windy conditions, the race could start anywhere from 1:15 to 2:40 this afternoon. one hour after the finish, the cup will be presented in the america's cup village. this is open to everyone. whoever wins the america's cup will celebrate with champagne

as you expect. as well as mum sparkling wine from napa. the america's cup is one of two major events in the bay area this week. it's splitting the time and attention of oracle ceo larry ellison. coming up how his -- firefighters are making progress against two wild fires that are burning in southern california. a plane dumped a fire redoor tent. it is 70% contained this morning. the wild fire began on monday. the sierra fire began yesterday afternoon. that quickly spread to 200 acres near a major freeway. mandatory evacuations were ordered for a couple dozen homes. but by midnight only voluntary

evacuations were under way. your time is 6:09. governor jerry brown goes to oakland today. he will sign legislation increasing california's minimum wage. the state minimum on july 1st of next year. then on january 1st, 2016 the minimum wage goes up again to $10 an hour. the governor will appear at a signing ceremony at noontime today. it will be at the city press mandela training facility. before aldon smith was arrested on drunk driving charges, he was stabbed at a party. why investigators now say -- what investigators now say triggered the stabbing. mostly smooth commute out there for a wednesday. you can see traffic looks good. there are some areas that you

during a party. investigators say someone pointed a gun at a bartender and smith tried to break up the party which was thrown by a friend. authorities say smith fired shots into the air. 27-year-old steven barba is accused of stabbing aldon smith. investigators say smith's roommate and delaney walker also fired shots into the air. they say someone else fired back. wounding two people. walker and smith have been named in a civil lawsuit. a former member of the san francisco fire commission could be charged today after being arrested on suspicion of domestic violence. donald carmanogi was arrested monday night. posted $130,000 bail. yesterday he resigned from the fire commission. police say his wife filed a report against him. accusing him of attacking and threatening her. 18 hours and counting.

man, it's been a marathon session. republican senator ted cruz was on the senate floor for hours. he has been talking about president obama's health care law. let's take you live to the senate floor where you can see that is senator james talking now. senator cruz has been trading off back and forth with his colleagues and letting the other republican senators speak. at one point he did read the dr. seuss book green eggs and ham and compared that children's story to obama care. >> i will tell you the difference with green eggs and ham. it's when americans tried it they did not like greens eggs and ham and they did not like obama care as well. >> senator cruz does not have enough votes to stop democrats from moving forward with a spending bill that keeps funding in raise for a health care law. we will find out how much health care premiums will be

under the affordable care act. the department of health and human services is releasing charts showing just how much the new health care insurance marketplace will charge for the so-called bronze, silver, and gold plans. for example before tax credits if you have a mid range silver plan, it would cost about $328 a month. time is 6:15. we have new information just within the last hour. the death toll from yesterday's magnitude 7.7 earthquake in pakistan went up to 271. look at this new video we got in. this is an island created by the force of that earthquake. off of pakistan's southern coast. incredible. people are gathering along the coast to see it. the head of the geological survey of pakistan is confirming the land mass was created by that earthquake. scientists are trying to figure

out exactly how it happened. emergency crews in colorado have found the last known missing person in that flood disaster zone. eight people are known to be dead in that disastrous flooding in boulder county. about 20,000 homes have been destroyed or damaged since the flooding started on september 12th. police say almost $50,000 worth of tool and equipment used to help disaster victims was stolen. workers at green horizon global corporated first reported the theft on monday in alameda. that company has a contract with cms to build emergency housing for victims of natural disasters. among the items taken were tools to build those shelters. >> see if there is any areas that have been compromised. windows, things like that.

>> the property owner estimates $40,000 worth of equipment was stolen. investigators are checking to see if there is surveillance video. a woman that lived in the santa cruz mountains is one step closer to becoming california's first core state. but now two family members are trying to prove she is worthy officiant hood. two miracles will have to be credited to her. usually they come in the form of unexplained medical cues. let's go back to sal. the winds are a part of our commute. you are watching bridges. >> we are telling people to be careful out there dave and claudine because it is windy and if you drive a small car, you could find yourself drifting into the other lane. they are looking at san mateo bridge and the wind advisories up there for that. these advisories are issued by

chp so they are not the same as the weather warnings but just for drivers here. westbound bay bridge that is backed up for a 10-15 minute delay. san jose we have seen pretty good traffic on 101. the whole time. a little slowing as you can see on 101. 6:18 let's go back to steve. thank you, sal. good morning, everybody. clear skies. patrick says the wind was howling all night long. not too bad right now. anywhere from 10-20 around the bay seems to be good. although not everybody. santa rosa says calm. sunny, breezy, there are a few upper 40s. clear skies. windy in the hills already. getting breezy to blustery already in some of the lower elevations. sunny. that is easy. cooler, breezy, and sunny but breezy to windy later on today. the wind advisories for the hills start tonight for fire watch. coldest air is beginning to work its way in from the north.

tahoe, truckee, re know looking -- reno looking for scattered showers. cooler and breezy to windy in spots. more breezy and windy and much, much cooler. snow showers likely laid tonight and into tomorrow. sunny for all today but it will be windy at times. mainly cooler and breezy for most. not for all. that wind will crank up more so tonight. really tough on these temperatures. we are seeing a little flip- flop in some of the temps that are usually inland. 60s to low and mid 70s. again warmest temps will be inland coming down now even by the coast and around the bay. everyone is pretty close here. a lot of low 70s.

police want your help in catching a man that punched a grocery store manager in an attack that was caught on video. look at the video. the manager briefly approaches a man before the man suddenly punches him. employees tell ktvu the manager was knocked out. he was rushed to the hospital later. investigators say they don't know what the two men said to each other before that attack. >> this isn't very common add all. so this is a major case to us. both us and safeway want to make sure we catch the person responsible. >> now surveillance cameras outside the store recorded the suspect running away. this all happened monday about 11:00 a.m.. if you have any information, call the san leandro police.

the legislation allows the sheriffs department to hold people for deportation only if they are charged with a violent felony and had a conviction for a violent felony in the passive years. it has been a contentious issue. some tech industry analysts say apple's report on iphone sales may be slightly misleading. apple says over us premier weekend it shipped nine million iphone 5s's and 5c's devices. even though apple seed them they didn't ship them yet and customers don't have them.

on ktvu channel 2 morning news i'm dave clark. >> and i'm claudine wong. pam cook has the morning off. time is 6:30. we want to head on over for a quick look at your weather and traffic. steve, there it is, breezy today. >> very good. sunny, breezy, and definitely cooler. we have temperatures that most in the 50s. if it wasn't for any breeze we would see a lot cooler temps. coldest air is about bo move in. it will be in northern california. we will get the cooler air but we also get the breeze out of that. 50 in santa rosa and calm. a lot of low to mid 50s. some locations picking up a pretty good breeze. about 15-25 miles an hour. a north wind banking on a little north wind. they can definitely warm up. the forecast is for clear, cooler this morning. the wind picks up. sunshine, breezy and cooler. the wind forecast already showing 17-22 around san francisco and the bay. i expect that to crank up after the noon hour as this entire

system dives down. you can see it. most of the cold air is up in oregon but it will be settling in. this will trigger scattered showers. cooler and breezy for us. sunshine all over the place. might see clouds along the coast parallel. it's just too much dry air for us. the wind 60s and 70s on our highs today. here is sal. steve, good morning. we are doing pretty well when it comes to the commute. when it comes to major accidents. but it's slowing down for sure. we do have high winds to talk about. this is highway 4. you can see the traffic is a little bit slow. it's not as bad as it was yesterday. it is a little slow coming over the hill to concord. no problems by the way on nearby 680 from the bah inertia -- benicia bridge to walnut creek. we have a lot of slow traffic this morning on 580 from livermore. it's dotted all the way up to the dublin interchange. then it gets better.

2 news. >> they come to the line. comeback is complete. and happening today sailing experts are calling it a miraculous comeback for oracle usa. they beat new zealand twice yesterday and ended up tying that america's cup race at eight points per team. alex savidge is live for us at the america's cup village in san francisco with a look at today's winner takes all race. alex. >> reporter: well, good morning. and oracle team usa it's been an incredible turn around for them. they got off to a terrible start in the america's cup. but later on today they are expected to take part in a winner take all final race. facing off against team new zealand later on today. it all hinges on the weather here. everyone keeping their eyes if you will on the wind conditions out here. i want you to take a look at the flags out here. we had seen them sort of -- the

winds pick up earlier. things have calmed down for right now. we'll have to wait and see what happens earlier this afternoon at 1:00 at race time. and this final race will only happen ifs if not too windy for the teams to go. a wind today by or -- a win today by oracle would cap off one of the greatest sports comeback. but since then, the team bankrolled by billionaire larry ellison has pulled out seven straight wins to draw even in the competition. it all comes down to this final race. the americans facing off with the oldest trophy in sports on the line. new zealand fans for their part are nervous while american fans feel energized. >> it's been very exciting. we are very proud of the oracle team. just very, very satisfying. to see them come through like this. >> we are actually quite worried. the whole country is worried.

>> reporter: and this has turned into the longest america's cup in history due in part to a couple of races that had to be delayed because of high wednesday. a lot of sailing fans have actually had to extend their visits to san francisco just to see how things will end. not necessarily a bad thing. but we are all set for a dramatic finish out on the bay today. i want to bring in live tim jeffrey. he's with the america's cup. how are things looking right now in terms of the wind conditions? >> right now it's looking perfect. but the time that matters is 1:15. it's looking good for a race. and we only need one race. today is winner takes all. oracle team usa wins, the cup stays in america. new zealand wins, the cup goes to new zealand. >> this is the kind of finish you hoped for when this all started. >> this is sport at its best.

in uncertainty over the outcome. no one knows how this contest is going to be. and we're just perched on the edge of our seat. >> should be fun. tim jeffrey with the america's cup. and again if the wind and weather conditions cooperate, that final race happens at the earliest 1:15 this afternoon out on the san francisco bay. live this morning in san francisco alex savidge ktvu channel 2 news. >> oracle ceo larry ellison's love for sailing has taken some of his attention from this week's oracle convention. the billionaire high-tech tycoon skipped the keynote speech at the convention yesterday because that is where he was. at those races. some people attending open world say part of the reason they pay the thousands of dollars in registration fees and travel expenses was to hear from ellison. about 60,000 people are attending that convention which does end tomorrow. some think if oracle wins the

cup ellison could come back and show them all the trophy to try to make amends. at ktvu.com you will find continuing coverage of the america's cup. all you have to do is look for the images tab which is right on our front page. time 16:38. san francisco police released surveillance video. here's the video. it shows the suspect on a muni train monday night moments before the deadly shooting. he is described as asian and between 20-30 years old. the shooting happened just after the victim got off that train at randolph and blight street. investigators don't know what prompted the attack. if you have any information call san francisco police. oakland police arrested two people. police say one of the men pulled out a gun and forced the car poolers to hand over all of

their valuables on monday morning. based on witnesses descriptions police were able to track down the getaway car and they did arrest a 17-year-old boy and 22- year-old man. they are trying to figure out if those two suspects are connected to other crimes in the area. according to the fbi annual crime report oakland has more robberies than any large city. that is more than double any other large california city. san francisco came in at 4.2 robberies per 1,000 residents. time is 6:40. starting tonight a fire weather watch begins for the north and east bay hills. the national weather service says you should expect a combination of stronger winds and low humidity. the warning comes after firefighters spent the night making sure a house fire in piedmont did not flair up

again. now the fire on maxwell road destroyed two houses. no injuries were reported. the cause of the fire is still under investigation. san francisco state university is giving their campus police officers tasers. that decision comes after an incident back in may when the police officers arrested suspected squatters from a campus dorm. the university officials say the tasers are compliance weapons that can stop situations from getting out of control. university police started training with tasers but the department still has to establish rules for their use before they arm all 28 officers. your time is 6:41. giving 911 a whole new look in menlo park. the new help you can send first responders from the scene of an emergency. we're live in san francisco

where an elderly couple is being evicted from this building after living here for 34 years. and if you are driving in san francisco northbound 101 traffic looks good approaching the 80 split. getting word of a crash now northbound 101 in san jose. mostly clear out there. just a few clouds. it will be sunny today but it will also be breezy, windy, and noticeably cooler.

welcome back. time now 6:44. happening today long-time residents of san francisco are facing eviction. ktvu tara moriarty is outside their home where tara, the deadline to pack up and get out is already passed. good morning. >> that is right. that way it happened 45 minutes ago. we still haven't seen any movement. we have been here since 4:00 this morning. this couple has lived here for 34 years. they have raised seven children here. and they currently live her with their daughter that is 48 years old and disabled. this is not too far from russian hill in north beach. the eight unit complex. the couple said they tried to find another place to live but they can't. math yew miller bought -- matthew miller bought the property and plans to renovate them into luxury tenant rates

channel 2 news. new information on how al qaeda linked terrorists carried out that -- they studied blueprints of the shopping mall. they rehearsed the attack and stashed machine guns in a shop in the mall with the help of an employee. the shopping center was heavily damaged during that four-day long fight. >> two floors of the west gate mall collapsed and there are several bodies still trapped in the rubble including the terrorists. >> this morning al-shabab claim there is are 137 hostages buried in the rubble of that shopping center but the kenyon government is denying that claim. the official death toll stands at 61 but that number is expected to rise after the mall is searched. time now 6:47. police department will update the technology that runs its emergency response system. this is a story you will only see on 2. the menlo park police

department just bought a next generation 911 system. costing $360,000. and it was paid for through phone taxes. now this system will be installed over the next two months. people will soon be able to text, send photos, and send videos to 911. >> the more information we can get into the 911 center, the bet our response can be. >> however there are concerns that extra digital information could possibly overload the system. and right now the experts are testing and retesting. just to see how much they can handle. agencies are required to upgrade their 911 systems every seven years and pay for them with phone taxes. the menlo park system as i said cost $360,000. other cities in the san mateo county that have the next generation 911 system include burlingame and san bruno. three bay area scientists

castaneda because certainly we have been expecting a lot of busy roadways this morning. and are we getting them? >> we are getting them. although yesterday was a lot busier. you will see the traffic is actually doing pretty well. welcome paired to yesterday as we go to a live picture of interstate 880. you can see it's moving nicely southbound toward hayward or northbound as you drive through there. it is backed up for about a 15- 20 minute delay. i want to mention there is a crash. it sounds like a noninjury crash. it is there. traffic is slow from south san jose. after that it remains slow. northbound 280 might be a better route for you. santa cruz mountains not a bad commute at all as you drive from highway 1 to highway 85 on
